EVALUATION BOARD/KIT/MODULE (EVK) WARNINGS, RESTRICTIONS AND DISCLAIMER
For FCC-Approved Units
TEXAS INSTRUMENTS (TI) PROVIDES THE ENCLOSED EVKS SUBJECT TO THE FOLLOWING TERMS:
NOTE: The term “EVK” includes electrical equipment commonly called Evaluation Kits, Evaluation Boards and Evaluation Modules
(EVMs)
For Feasibility Evaluation Only. This EVK is not a finished product. It is intended solely for use for preliminary feasibility
evaluation, experimentation and/or scientific analysis involving TI semiconductors, by persons who are qualified to conduct such
tasks. This EVK should not be used as all or part of a production unit. Before handling the EVK you should consult the EVK Kit
Insert, including the Warnings, Restrictions and Disclaimers.
Your Sole Responsibility and Risk. You acknowledge, represent and agree that:
1. You assume all responsibility and liability for proper and safe handling of the EVK. Further, you are responsible to assure that
any interfaces (electronic and/or mechanical) between the EVK and any human body are designed with suitable isolation and
means to safely limit accessible leakage currents to minimize the risk of electrical shock hazard. You agree to employ reasonable
safeguards to ensure that your use of the EVK will not result in any property damage, injury or death, even if the EVK should fail to
perform as described or expected.
2. If you design and/or produce end products or subassemblies for incorporation into end products, then you acknowledge,
represent and agree that you have unique knowledge concerning the Federal, State and local regulatory requirements (including
but not limited to Food and Drug Administration regulations, if applicable) which relate to your products and which relate to your
use (and/or that of your employees, affiliates, contractors or designees) of the EVK for evaluation, testing and other purposes.
Notwithstanding any design support or recommendations that TI may provide, you are solely responsible for your end product or
subassembly, and for providing “fail-safe” mechanisms and/or other safety measures as may be necessary or appropriate in any
potentially hazardous applications, in light of the possibility of failure of semiconductor components.
EVK Warnings and Restrictions. Failure to operate this EVK within TI’s recommended specifications and environmental
considerations per the instructions in the EVK User’s Guide may present risk of personal injury, property damage and/or
unexpected operation of the EVK. During normal operation within the EVK’s recommended ratings, some circuit components,
including but not limited to linear regulators, switching transistors, pass transistors, current sense resistors and heat sinks may
have elevated case temperatures or contain voltages exceeding safe touch levels. The EVK User’s Guide may include a schematic
drawing which identifies such components. When placing measurement probes near or on these devices during operation for
evaluation purposes, precautions should be taken against inadvertent contact with surfaces of elevated temperatures and/or
voltages exceeding safe touch levels. Questions may be directed to a TI field representative.
Limited Warranty. Should the evaluation board/kit not meet the specifications indicated in the User’s Guide, the board/kit may be
returned within 30 days from the date of delivery for a full refund. THE FOREGOING WARRANTY IS THE EXCLUSIVE
WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED, IMPLIED OR STATUTORY, INCLUDING ANY
WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE. NEITHER PARTY SHALL BE LIABLE TO
THE OTHER FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
No IP Rights. No license is granted under any patent right or other intellectual property right of TI covering or relating to any
machine, process, or combination in which TI products or services might be or are used. TI assumes no liability for applications
assistance, customer product design, software performance, or infringement of patents or services.
Regulatory Information. This device complies with part 15 of the FCC Rules. Operation is subject to the following two conditions:
(1) This device may not cause harmful interference, and (2) this device must accept any interference received, including
interference that may cause undesired operation. Changes or modifications not expressly approved by the party responsible for
compliance could void the user’s authority to operate the equipment. This Class A digital apparatus complies with Canadian
ICES-003. Cet appareil numérique de la classe A est confor á la norme NMB-003 du Canada. Les changements ou les
modifications pas expressément approuvés par la partie responsable de la conformité ont pu vider l’user’; autorité de s pour
actionner l’équipement.
